Popülist Söylemin Perde Arkası: 5224 Sayılı Sinema Filmlerinin Değerlendirilmesi ve Sınıflandırılması İle Desteklenmesi Hakkında Kanun’a Dair Değerlendirmeler

Abstract

Bağımsız sinemanın en büyük problemlerinden birinin dağıtım olduğu düşünülürse değişiklik yapılarak yeniden düzenlenen 5224 Sayılı Sinema Filmlerinin Değerlendirilmesi ve Sınıflandırılması ile Desteklenmesi Hakkında Kanun, bu probleme nasıl bir çözüm üretmektedir? Yapılan değişiklikler hangi sorunları temel almaktadır? Bu değişiklikler sinema endüstrisinin temel problemlerini ortadan kaldırmaya yeterli midir? Çalışma, 5224 Sayılı Kanun ile bağımsız sinemanın güçlendirilen sessizleştirme biçimlerini, üretim, dağıtım ve gösterim koşullarını genel olarak tartışmayı hedeflemektedir. Bu amaçla öncelikle sinema endüstrisinin dönüşümüne dair kuramsal çerçeveye yer verilmekte ve bu endüstrinin güçlenmesini sağlayan devlet desteği ve fon yapısı incelenmektedir. Çalışmada Türk sinema endüstrisine ilişkin kaynaklar literatür taraması yöntemi ile ele alınarak var olan sorunlar tanımlanmakta ve öneriler sunulmaktadır. Sinema endüstrisi ile ilgili nicel veriler, bağımsız sinema kuruluşu Antrakt, Avrupa Görsel İşitsel Gözlemevi’nin Raporu ve Kültür Bakanlığı resmi kaynaklarından elde edilmektedir. Bu veriler ışığında yapılan değerlendirmelerde; Türk Sinemasının yaşamış olduğu ekonomik büyümenin, bağımsız filmlerin perdeyle olan mesafesini daha da araladığı ve var olan üretim, dağıtım ve gösterim sorunlarına yenilerini eklediği görülmektedir. Yapımcıların daha çok pay alması sorununa indirgenerek değiştirilen yasanın sadece dengesiz ekonomik büyüme sorununa çözüm üreten bir niteliğe sahip olduğu ve dağıtım ya da gösterim sorunlarında yetersiz kaldığı söylenebilir.

As known, one of the most significant problems of independent cinema is the distribution, how does the Law No. 5224 on Assessment and Classification of Motion Pictures, which has been amended, bring a solution to this problem? What problems are the modifications made based on? Are these modifications sufficient to eliminate the fundamental problems of the cinema industry? The study aims to discuss the empowered forms of silencing and production, distribution and screening of Independent Cinema with Law No. 5224. For this purpose, the theoretical framework for the transformation of the cinema industry is provided initially, and the state support and fund structure that empowers this industry are examined. In this study, resources related to Turkish cinema industry are discussed through literature review and existing problems are identified with suggestions presented. Quantitative data on the cinema industry are obtained from the official sources of the independent cinema company Antrakt, the European Audiovisual Observatory Report and the Ministry of Culture. The evaluations carried out by using the mentioned data; it is seen that the economic growth of Turkish Cinema has further expanded the distance of the independent films with the screen and existing production, distribution and screening problems have increased. It can be said that the law amended by only focusing on the problem of producers and them to receive more shares is only a result of unbalanced economic growth. And this amendment provides a solution to the problem, however it is inadequate to solve the problems experienced in distribution or screening.
