Özel Güvenlik Teşkilatı: Türkiye Örneği

Abstract

Güvenlik ihtiyacı insanın doğasında olan ve fizyolojik ihtiyaçlardan sonra gelen önemli bir ihtiyaçtır. Bu ihtiyacın karşılanması amacıyla devletlerin kurumsal olarak ortaya çıktığı ve toplumsal güvenlik ihtiyacını karşılamak üzere binlerce yıldır kendi zamanlarının gereksinimlerine göre çeşitli kurum ve kuruluşlar oluşturdukları gözlenmiştir. Zamanla oluşan riskler ölçüsünde güvenlik ihtiyacı artarak devam etmiş ve devletler kendi kontrolünde; kısmi olarak güvenliğin özel teşebbüsler eliyle karşılanmasına yönelik kararlar almışlardır. Kamu yetkisinde bulunan güvenliğin devlet dışı kişi ve kurumlara devrediliyor olması bu sektör üzerinde titizlikle durulması gerektiğini göstermektedir. Özel güvenlik hizmetlerinin uygulamasında karşılaşılan sorunların bilimsel bir çalışmayla araştırılması, sektörün tanınması ve denetlenmesi bakımından büyük önem arz etmektedir. Bu çalışmada ilk olarak güvenlik hizmetinin anlam, önem ve özellikleri ifade edildikten sonra kolluk çeşitleri sınıflandırılarak özel güvenlik teşkilatının yeri ve önemi üzerinde durulmuştur. Özellikle 2495 sayılı "Bazı Kurum ve Kuruluşların Korunması ve Güvenliklerinin Sağlanması Hakkındaki Kanun"un yerine 10 Haziran 2004 tarihinde yürürlüğe giren 5188 sayılı "Özel Güvenlik Hizmetlerine Dair Kanun"un getirdiği yenilikler ile bu kanunla kurulan özel güvenlik teşkilatlarının, eğitim, kuruluş, görev, yetki, hak ve sorumlulukları açıklanmış, sektörle ilgili güncel kanuni düzenlemeler paylaşılmıştır. Çalışmamızda özel güvenlik kavramına açıklık getirilmiş, özel güvenliğin dünyada ve Türkiye'deki tarihsel gelişimi incelenmiş, güvenlik hizmetlerinin kısmen özel güvenliğe devredilme süreci üzerinde durulmuş, özel güvenlik kuruluşları detaylarıyla anlatılmıştır. Ayrıca özel güvenliğin; faaliyet alanları, yetkileri, denetlenmesi ve eğitiminden detaylı bir şekilde bahsedilmiş, Türkiye özel güvenlik sistemi, Avrupa Birliği ülkeleri özel güvenlik sistemleri ile çeşitli yönlerden karşılaştırılarak sektörün yapısı, işleyişi, tanıtımı ve sahada ortaya çıkan sorunları ele alınarak bu sorunlara çözüm önerileri sunulmuş, sektörün gelişiminde katkıda bulunulmuştur.

The need for security is one of the crucial need that just comes after the physiological needs of human nature. In order to meet this need, it has been observed that the concept of "state" emerged institutionally. Historically, the need for security has continued to increase in line with the emerging risks and in today's contemporary world, it is seen that states have taken the decisions about, with its own control, ensuring the concept of security partially by private initiatives. The fact that, transferring the process of "ensuring the security" from state authorities/forces to non-state/private actors/organisations is an issue that make this sector need to be examined deeply.The examination of the problems that encountered in the provision of private security services through a scientific study is highly important in terms of recognition and supervision of the sector. In this study, firstly the significance, importance and features of security service are expressed and after then the types of law enforcement that are classified and the importance of private security organization is emphasized.Particularly, the novelties of the Law No. 5188 on "Private Security Services" that was come into force on June 10, 2004, instead of Law No. 2495 "Law on the Protection and Protection of Some Institutions and Organizations" are examined. The education, organization, duties, authorities, rights and responsibilities of private security organizations that established by this law are also explained. In this study, the concept of "private security" has been clarified, the historical development of private security sector in the world and in Turkey has been examined, the process of transferring security services partially to private organisations has been emphasized and explained in detail.In addition, the areas of activity, authorisation, supervision and education of private security is mentionedand Turkey's private security system has been compared with the private security systems of the European Union in various aspects in order to show the problems in sector and solution proposals have been presented.
