Bürokratik Yapı Açısından Tanzimat Dönemi Sonrasında Adliye Nezareti ile (1876 - 1914) Cumhuriyet Dönemi Adalet Bakanlığının Karşılaştırılması

Abstract

Bu tez çalışmasında Türk Adalet Sisteminde oluşturulan ilk adliye teşkilatı ile Cumhuriyet sonrasından günümüze kadar adliye teşkilatı hakkında yapılan kapsamlı araştırma bir bütün olarak tüm detaylarıyla birlikte verilmiştir. Osmanlı Devleti köklü bir imparatorluk olarak yüzyıllar boyunca 3 kıtada hüküm sürmüş ve bu topraklar üzerinde yaşayan toplulukları idari ve adli yönden dönemin koşullarına en uygun şekilde yönetmiştir, her döneminde bir hukuk sistemi ( örfi –şer'i) bulunan İmparatorluk bu sayede 700 yıllık dünyaya hükmettiği dönemde dimdik ayakta kalabilmiştir. Cumhuriyet sonrasında da yine gelişen ve değişen dünyada Türkiye Cumhuriyeti olarak yenilenen bu devlette hukuk sistemi de yenilerek değişmiştir. Ancak hukuk sistemi ve Adalet teşkilatlanmasının temelleri Tanzimatla birlikte atılmıştır. Çalışmamızın ilk bölümünde Adliye Nezareti olarak kurulan bu teşkilatın idari yapısı, teşkilata bağlı komisyonlar bu dönemde adliyelerde görev yapan memurların seçilme ve tayinleri ile tayinlerde yapılan düzenlemeler, özlük hakları ile Adliye Nezaretine bağlı mahkemelerde yapılan düzenlemelerle ilgili araştırmalar verilmiştir. Çalışmamızın ikinci bölümünde ise; Cumhuriyet sonrası Türkiye Cumhuriyeti Adalet teşkilatı sistemi ile ilgili bilgiler sunulmuştur. Öncelikle Adalet Bakanlığının teşkilatı ve bakanlığa bağlı diğer birimler ile adliye teşkilatı ile teşkilat bünyesinde bulunan mahkemeler ve savcılık makamlarına ait idari yapılar hakkında bilgiler verilmiştir. Çalışmamızın üçüncü ve son bölümünde ise; Adliye Nezaretinin kuruluş yıllarındaki teşkilat genel idari yapısı ile Cumhuriyet sonrası Adalet Bakanlığı teşkilatının genel idari yapısı karşılaştırılmıştır. Ayrıca, bu iki dönemin mahkemeler ve hukuk sistemi açısından da karşılaştırılarak sonuç olarak Adliye Nezaretinin kuruluşu dönemindeki teşkilat yapısında ve hukuk sisteminde yer alan sorunlar ve aksaklıkların Cumhuriyet sonrasında ve halen günümüzde de devam ettiği tespit edilmiş olup, teşkilattaki aksaklıkların giderilmesi amacıyla kurulan pilot adliyelerdeki yenilikçi uygulamalardan Adliye Müdürü kadrosu, ön bürolar ve danışma masaları vb.) bazılarından bahsedilerek çözüm önerilerinde de bulunarak genel bir değerlendirme yapılmıştır. In this thesis, the Turkish justice system that is created in the aftermath of the First Republic to the present day Courthouse, the courthouse as a whole are given along with comprehensive research about all the details. Rooted in the Ottoman Empire as an empire reigned in 3 continents over the centuries, legal and administrative aspects of the communities who live on this land and the conditions of the period is managed in the most appropriate way to, in each period a legal system the Empire in this way, the 700-year-old ruled the earth during the period when remain standing. After the Republic, the Republic of Turkey is still developing and the legal system in the states in a changing world renewed as too much has changed. However, in the tanzimat period in the foundations of the organization of Justice and the legal system have been taken. In the first part of our study, the Ministry of Justice established this organization of the administrative structure, organization, and selection of civil servants who work in the courthouse affiliate commissions during this period with determination in the determination arrangements, with benefits on the courthouse custody in court, has been given to research related to the arrangement. In the second part of our study; the system of Justice of the Republic of the Republic of Turkey presented information about the organization. Primarily the organization of the Ministry of Justice and the Ministry of the courthouse with other units of the organization with the organization within the structure of the courts and the prosecution authorities are given information about the administrative structure. The third and final section of our study, the Ministry of Justice in the foundation years of the administrative structure of the organization with General Post-General of the organization of the administrative structure of the Ministry of Justice republic were compared.
