Hava taşımacılığında insan ticaretinin önlenmesine dair farkındalık oluşturmaya yönelik bir eğitim önerisi

Abstract

İnsan ticareti suçu uzun yıllardır mücadele edilen sınıraşan bir suç türüdür. Bu suç çoğu zaman göçmen kaçakçılığı ile karıştırılmakta olup arasındaki ayrımın farkına çoğu zaman varılamamaktadır. Oysa ikisi birbirinden farklı kavramlardır. Kaçakçılık suçunda göçmenin rızası mevcutken insan ticaretinde mağdurun rızası bulunmamaktadır. Kaçak yöntemlerle ülke değiştiren kişilerin kaçakçılarıyla olan ilişkileri ilgili ülkeye vardıklarında ve ödemeyi yaptıklarında sonlanır. İnsan ticaretine konu olan mağdurlar ise götürüldükleri ülkede tacirleri tarafından çeşitli sebeplerle sömürülürler. Bu sömürü türlerinin başında cinsel sömürü ve emek sömürüsü gelmektedir. İnsan ticareti ile mücadele için devletler arasında imzalanan sözleşmeler bulunmaktadır. Devletler bu suça karşı kendi iç işleyişlerinde de çeşitli önlemler almakta, mağdurları korumaya yönelik programlar geliştirmektedir. Ayrıca mağdurların sevki sırasında kullanılan ulaşım yolu personellerini eğitmektedir. Havayolu taşımacılık sektörü çeşitli özellikleri nedeniyle insan tacirleri tarafından giderek daha fazla kullanılmaktadır. Bununla birlikte hava taşımacılığı, yolcuların check-in işleminden varışta pasaport kontrolüne kadar tüm süreç boyunca gözlem altında tutulması nedeniyle insan ticaretini tespit etmek ve müdahale etmek için birçok fırsat da sunmaktadır. Özellikle havayolu personelinin konu hakkında bilgi sahibi olması mücadele açısından çok önem taşımaktadır. Bu çalışmanın temel amacı dünyada bir süredir havacılık personeline uygulanmakta olan ama henüz Türkiye'de mevcut olmayan insan ticareti farkındalık eğitimi için bir öneri sunmaktır. Çalışmada doküman analizi yöntemi ile veriler (havacılık otoritelerinin eğitimleri, bilimsel yayınlar, konuyu aydınlatabilecek olan çeşitli dokümanlar vs.) toplanmış ve betimsel analiz yöntemiyle bu veriler işlenmiştir. Sonuç olarak ise farkındalık oluşturmaya yönelik bir eğitimin insan ticaretini önleme yolunda önemli katkılar sağlayacağı kanısına varılmıştır.

Human trafficking crime is a transnational crime that has been fought for many years. Majority number of this crime are often confused with migrant smuggling and noticing the distinction between those two crimes can not identified easily. However, the two are different concepts. In the crime of smuggling while the consent of the migrant is present, whereas there is no consent of the victim in human trafficking. The relations disconnects with smugglers of migrants who changed countries when migrants arrive and pay the charge. Whereas victims of human trafficking on the other hand, they are exploited by their merchants for various reasons in the country they are taken to. This exploitation sexual exploitation and labor exploitation come first among its types. There are agreements signed between states and countries to combat human trafficking. States also take various measures in their internal operations against this crime, as well as international operations. It develops programs for protection. The air transport sector is increasingly used by human traffickers due to its various features. However, air transport also offers many opportunities to detect and respond to trafficking, as passengers are monitored throughout the entire process, from check-in to passport control on arrival. Also during the referral of victims states trains the personnel of the transportation route used. Especially the subject of aviation and airline personnel. It is very important and vital to have information about the struggle. The main purpose of this study is to present a proposal for human trafficking awareness training, which has been applied to aviation personnel in the world for a while but is not yet available in Turkey. In the study, data (trainings of aviation authorities, scientific publications, various documents that may illuminate the subject, etc.) were collected by document analysis method and these data were processed with descriptive analysis method. As a result, it has been concluded that an awareness-raising education will make important contributions to the prevention of human trafficking.
